Based on Article 28, item 6, and Article 32, item 5, of the Statute of FBiH Judges Association (hereinafter referred to as Statute), following the proposal of the Presidency of the Association, the Association Assembly, has adopted


RULES
OF PROCEDURE BEFORE COURT OF HONOUR OF FBiH JUDGES ASSOCIATION



I GENERAL PROVISIONS

Article 1.
For the purpose of the implementation of the provisions of the Judges Code of Ethics (hereinafter referred to as Code) pertaining to responsibility for violoations of the Code committed by judges, the FBiH Judges Association Assembly hereby sets forth the rules of procedure to be observed before the Court of Honour of the FBiH Judges Association (hereinafter referred to as Association).


Article 2.
In accordance with provisions of the Statute, the Court of Honour will identify cases constituting violations of the Code and take decisions to exclude members violating the Code or to issue warnings in compliance with these rules of procedure.

 

II PROCEDURES BEFORE THE COURT OF HONOUR


Article3.
Procedures before the Court of Honour will be conducted in accordance with the provisions of the Statute, the Code, and these rules, along with adequate application of the Law on Criminal Procedure.


Article 4.
Procedures before the Court of Honour will be initiated by the Association Presidency by filing a proposal to institute a procedure of taking decision to exclude responsible members or to issue a warning, along with stating specific behaviour constituting a violation of the Code.
The proposal for instituting procedures before the Court of Honour can be made by Association members and all FBiH citizens.


Article 5.
Following the hearing of the member who has violated the Code and the presentation of evidence, the Court of Honour will take decision by majority vote based on the proposal mentioned in Article 4, paragraph 1, of these Rules.


Article 6.
If a member of the Association does not respond to two consecutive subpoenas, the Court of Honour will take decision without hearing the member, based on proposals and presented evidence.
Such decision will be completed in writing in a period of 30 days and the copies forwarded to the Association Presidency and the involved member.


Article 7.
The involved member can appeal such decision to the Association Assembly within the period of 15 days following the receipt of decision.

 

III TRANSITIONAL CLOSING PROVISIONS


Article 8.
Records on measures against Association members will be maintained by the Association Presidency.


Article 9.
The Association Assembly at proposals of the Association Presidency will take decisions on amendments of these Rules.


Article 10.
These rules will be effective starting on the day of their adoption by the Association Assembly.
