According to the article 28 of the Statute, and by implementing the
Decision of 2nd Regular Assembly of AJF BiH, members of the Association
of Judges' in FBiH hereby adopt
THE ETHICS' CODE FOR JUDGES IN FEDERATION OF BOSNIA AND HERZEGOVINA
By respecting the importance of judicial role for life of citizens
of the Federation of Bosnia and Herzegovina,
By acting in supporting ideals of democracy, pluralism and rule of
law,
By efforts to strengthen the independence of judiciary in the entire
Federation of Bosnia and Herzegovina,
By hoping for judges in Federation of Bosnia and Herzegovina to act
in accordance with norms accepted in Europe and elsewhere in International
Community,
By acknowledging the universality of moral norms that judges need
to implement, without consideration of their legal tradition, and
further more, by adopting the Recommendation of the Council of Europe
number R (94) 12 of Committee of Ministers of Member countries regarding
independence, efficiency and role of judiciary,
On behalf of there organization, signed below have agreed to respect
this Ethics' Code for judges in Federation of Bosnia and Herzegovina.
Article 1
Independence of judges
Judges shall work independently of executive and legislative authorities,
and shall not be influenced by directions of any other branch of government.
Judges shall fulfill their duties based on facts and laws, applicable
in each and every case. Judges shall respect the Constitution of Bosnia
and Herzegovina and the Constitution of the Federation of Bosnia and
Herzegovina. Judges must be immune on local, entities or national
political influence of any kind.
Article 2
Fundamental impartiality
Judges shall fulfill their duties impartially and shall always act
on a way that is equitable to each party in a process. Judges shall
never allow their personal feelings or prejudice or favoritism to
affect their work in any way. Judges must fulfill their duties by
respecting dignity of each and every party in a process.
Article 3
Conflict of interests
Judges must avoid any possible conflict of interests based on family
connections, friendship, and/or financial or professional ties. They
shall inform all parties in a process of existence of any such relation
that judge might have toward any party or witness in a process. Judges
must avoid both real disproportions of any kind and anything that
might be considered disproportional in a way of their work. Judges
are required to withdraw from a case if basic reasons that might be
considered as a conflict of interests exist.
Article 4
Professionalism and training
Judges must always maintain the highest standards of professionalism
and legal profession. Judges must work hard in maintaining and improvement
of their legal knowledge and be in track of its development. Judges
are expected to be actively involved in on-going training in legal
field.
Article 5
Activities on a side
Judges shall not be members of any political organization. They could
be members of professional and other social organizations that are
not involved nor support discrimination based on, but not excluding,
ethnicity or nationality, sex, religion or physical defect. Judges
might be involved and publish articles of academic or other investigative
activities in their professional domain, but shall always consider
applicability of a subject they work on, ways of presentation and
professional dignity.
